Calgary mom who strangled daughter gets suspended sentence Aset Magomadova placed on probation for three years

CALGARY – The Calgary mother who killed her teenage daughter by strangling her with a scarf more than three years ago will not have to spend a day in jail, a judge ruled on Thursday.

But, in suspending the sentence of Aset Magomadova and placing her on probation for three years, Court of Queen’s Bench Justice Sal LoVecchio said the penalty can still meet the ends of justice.

“At first blush (a suspended sentence) may sound like a get out of jail free card. It is not,” emphasized the judge.

“The court has said the act in question does not merit a period of incarceration. What the court has done is reserved or to use the word of the statute, ‘suspended’ judgment on that point for a period of time on conditions. If the conditions are satisfied, then the individual will not be sentenced. If they are breached, the individual will be brought back to the court to be dealt with further.”

Magomadova, 40, a refugee from the wartorn country of Chechnya, was originally charged with second-degree murder for killing her daughter Aminat, 14, on Feb. 26, 2007, at their Calgary home.

But LoVecchio deemed she did not intend to kill her, even though such an act required at least 2 1/2 minutes of continuous strangulation to cause death, and convicted her last October of the lesser included offence of manslaughter.

Call it a failure to launch.

The White House is disavowing a plan to have NASA conduct outreach to Muslim countries, but a congressman who talked to NASA Administrator Charles Bolden about that plan last month said the initiative was very real until somebody slammed the brakes on it.

Rep. Pete Olson, ranking Republican on the Space and Aeronautics House Subcommittee, told FoxNews.com that Bolden described the outreach program as part of the administration’s space plan during a conversation they had in June.

“He confirmed it to me,” Olson said. The Texas Republican said he thinks the program existed until the “uproar” compelled the administration to rethink it.

News came from the White House on July 6 that the President used his recess appointment power to install Dr. Donald Berwick as Administrator of the Centers for Medicare and Medicaid Services (CMS).  Dr. Berwick is a Harvard doctor and professor, but of particular interest and concern is his chairmanship of the non-profit Institute for Healthcare Improvement and the platform it has provided for his views on expanding government control over personal medical decisions.

Woman injured when box explodes outside home

A Houston woman was injured on Friday after a device that appeared to be a homemade bomb exploded when she opened a package in her back yard, authorities said.

The woman, who authorities said was in her 60s, was taken to Memorial Hermann Northwest Hospital with non-life-threatening injuries, officials said.

Between 6:30 and 7 p.m., she opened a shoebox-sized box that had been dropped off at her home in the 2100 block of Seamist Court in northwest Houston.
