The OLC “Kill” Memo: Is there really anything to be alarmed about?

President Bush had the OLC “torture” memos, because he felt making high value targets uncomfortable to save American lives was important. President Obama has his “kill” memo, because he feels it legally messy to capture and interrogate over simply killing terrorists; and he includes American citizens as possible HVTs who can be targeted for extermination without due process….to make America safe.
In wake of John Brennan’s confirmation hearing today for the position of CIA Director (with questions to answer for, from the left and the right), and amidst pressure from those on the right AND the left, President Obama has agreed to sharing the OLC “kill” memo with congressional intelligence committees.

Senate committee Chairman Dianne Feinstein (D-Calif.) said she was “pleased” with the decision. “It is critical for the committee’s oversight function to fully understand the legal basis for all intelligence and counterterrorism operations,” Feinstein said in a statement.

It is with great respect, admiration and deep understanding that I write this letter to honor each and every Veteran that has served or is serving our blessed Country! I understand and appreciate all who have given so much for me, so that I could enjoy my daily freedoms.
I was able to sleep well in the safety of my bed last night, because you served.
I was able to pray before my meal this morning in a public place without fearing arrest, because you gave.
I am able to freely speak my mind and voice my opinion without fear of retaliation against me or my family, because you cared.
I am able to stand up for what I believe in and not have a Dictators thoughts and opinions forced down my throat, because you stood up to the call to defend.
I am free to worship the one true God who created me in His image, because you were selfless in your actions.
To each one of you I speak from the bottom of my heart when I say Thank you, thank you, thank you! You are my heroes and I want to remember and honor you this Veterans Day. Not a single day goes by that I don’t think of the sacrifices you and your families have given!

He ‘hates farming, hates the military, hates the U.S. and we hate him!’
Country-music legend Hank Williams Jr. unleashed another round of less-than-flattering words for Barack Obama, this time Friday night at the Iowa State Fair.
According to the Des Moines Register, after Williams performed the song “We Don’t Apologize For America” a chant of “USA, USA” broke out among the crowd.
The singer responded with a smile, telling the audience he was their mouthpiece and added:
“We’ve got a Muslim president who hates farming, hates the military, hates the U.S. and we hate him!”
The crowd apparently loved what it heard, responding with “loud and enthusiastic” cheers.
The Register says when reached for comment Saturday, Brad Anderson with the Obama campaign in Iowa said, “That type of absurd nonsense doesn’t really deserve a response.”
In July, Williams Jr. told Rolling Stone magazine Obama “hates America in the first place, forget about the flag.”
Last October, the music legend received massive publicity when he appeared on “Fox & Friends” and blasted a golf game between Obama and House Speaker John Boehner.

In the run-up to this weekend’s G-8 summit at Camp David, journalists have unfavorably compared European “austerity” with Barack Obama’s economic policies.
European spending cuts, the argument goes, have hurt people and are arousing political opposition, while Obama’s proposals to keep federal spending at 24 percent of gross domestic product indefinitely are likely to succeed.

What If the Government Rejects the Constitution?

What if the government never took the Constitution seriously? What if the same generation — in some cases the same human beings — that wrote in the First Amendment, “Congress shall make no law … abridging the freedom of speech,” also enacted the Alien and Sedition Acts, which made it a crime to criticize the government? What if the feds don’t regard the Constitution as the Supreme Law of the Land?
What if the government regards the Constitution as merely a guideline to be referred to from time to time, or a myth to be foisted upon the voters, but not as a historic delegation of power that lawfully limits the federal government? What if Congress knows that most of what it regulates puts it outside the confines of the Constitution, but it does whatever it can get away with? What if the feds don’t think that the Constitution was written to keep them (the Government) off the people’s backs?

The President of the United States just stated that the Supreme Court has no business in striking down a law passed by Congress because it was democratically voted in by its majority.”. He then explained the meaning of Judicial Activism, by saying a Supreme Court which strikes down a Congressional Law, signed by the President, is Judicial Activism. ..Huh! He supports that by saying if his Health care fiasco is struck down by the court, that will be unprecedented! …What!
Double “Good Grief”. Striking down unconstitutional laws is the job description of the Supreme Court of the United States. I suggest he read Article III, Section 2, first sentence referencing the Supreme Court: “The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and …etc.”.

The Patient Protection and Affordable Care Act (PPACA), or Obamacare, is off to the Supreme Court for a three-day marathon of oral arguments. Lawyers representing the federal government will attempt to prove the law’s constitutionality; those representing private individuals, the National Federation of Independent Business, and most prominently, 26 states, will argue that PPACA violates the supreme law of the land.The Court has allotted six hours for arguments, and while it doesn’t seem like much time for such a contentious and crucial issue, bear in mind that the court typically grants a case just one hour. This is the most argument time given in 47 years.
So what questions will the Court answer? What will the lawyers argue? How might the Justices vote? I have a seat inside the courtroom for all six hours of arguments, so expect a full report on the proceedings, as well as a preview each morning of the question before the Court that day. For now, however, we’ll take a general look at the schedule, the questions, and the basic arguments each side will make, in preparation for Obamacare’s big day in court.

I have written on the unconstitutionality of the Federal Reserve System before and how that fiat money is not to be printed by the federal government in any form. The Constitution is clear that only gold and silver coin is to be coined by the government. Those metals are the only metals they have authority to coin. Yet the propaganda machine of the Federal Reserve is now putting out it’s own educational propaganda material in order to teach 8-12 graders otherwise.

Women Prefer Santorum to Romney by 10-Point Margin, Says Gallup

(CNSNews.com) – In a week when much of the national media attention on former Sen. Rick Santorum’s presidential campaign focused on his views on contraception, the Gallup tracking poll showed Santorum’s support among women increasing by 12 points, vaulting him into a 10-point lead among women over former Massachusetts Gov. Mitt Romney.
In fact, Santorum’s support among women in this latest Gallup poll is stronger than his support among men.
In the week of Feb. 13-19, according to Gallup’s presidential primary tracking poll of registered Republican voters and Republican-leaning independents, Santorum led Romney 34 percent to 29 percent among men and 36 percent to 26 percent among women.

CBO: U.S. enduring the longest period of high unemployment since the Great Depression

After three years with unemployment topping 8 percent, the U.S. has seen the longest period of high unemployment since the Great Depression, the Congressional Budget Office noted in a report issued today.

And, despite some recent good news on the economic front, the CBO is still predicting that unemployment will remain above 8 percent until 2014. The report also notes that, including those who haven’t sought work in the past four weeks and those who are working part-time but seeking full-time employment, the unemployment rate would be 15 percent.
The CBO made its comments in a report examining the long-term effects of joblessness, and possible policy options to boost employment, including unemployment insurance reforms and job training programs. The report came at the request of Democratic Michigan Rep. Sander Levin, but Republicans quickly jumped on the chance to bash President Obama’s stimulus program, which is also reaching its three-year anniversary today.

Where Your Rights End and Mine Begin

As a child, I used to play with the neighbors across the street in one of the coolest sandboxes one could imagine. It was built into the landscape, with giant boulders lining the back and sides. Five kids could easily play in it, building sandcastles and manipulating bulldozers and dump trucks to their hearts content. Hours could go by before being called home to dinner. There was only one problem… neighborhood cats considered that magical place as their personal giant sized litter box. We were often told, sadly, that we could not play in it because of this ongoing problem.
These past few months, renting a home in a beach community has allowed my dog and I the opportunity to take a daily walk along the shore, where I hunt for shells, watch for porpoise, and occasionally exchange niceties with the fisherman who set up their poles in the sand, and with the locals who are also enjoying their surroundings. Every day, I thank my blessings that I’ve been given this chance to live in such surroundings but my happiness is often interrupted by dogs roaming the beach, unleashed, in violation of the rules which are clearly posted at each entrance. Not only do these dogs defecate on the sand but often they are not well behaved, running at leashed dogs, children, solitary walkers, and anyone within their proximity.
I do not fault the dogs. I am a dog lover and I understand that dogs are social creatures. My problem is with the owners who clearly do not consider that some dogs may respond aggressively to such provocation, children and adults may be afraid of their beloved pets, and some beachcombers may not want to worry about stepping on dog feces, let alone experience being showered by a dog shaking out its wet fur, when their intention is to savor the sand and water running between their toes. The worst offenders do not attempt to corral their dogs around other people and assume because their dogs are friendly, all is well with the world. They do not comprehend the compromise which allows both dogs and people to enjoy this pristine environment.

You may be aware of this week’s NLRB showdown, where two Democratic Members of the National Labor Relations Board will try on Tuesday to overhaul rules governing 6 million workplaces and about 100 million working Americans to make it easier for union bosses to organize new members. The consequences are serious: employees will get less information about what they’re signing up for and employers will have less chance to talk to their workers. The unelected bureaucrats say they’re helping employees, but really it’s just to help the big political spenders from Big Labor. But you can help stop this farce!
While the Obama administration doesn’t seem to want to listen to small business owners, other leaders in D.C. will get the message. New Liberal Study: Obama Admin. Changes More Federal Rules Than Bush

A new report from the liberal Center for Progressive Reform (CPR) says that the White House Office of Information and Regulatory Affairs (OIRA) under the Obama Administration has made more changes to federal regulations– including EPA rules– than their Bush Administration predecessors. The CPR blog writes:
“The results were shocking even to us, long-time and admittedly jaded observers of OIRA’s one-way ratchet toward weakening public health and other protections.
Obama’s OIRA changes more rules than Bush’s did. The Obama Administration has further entrenched a regulatory system in which White House officials trump agency expertise with decisions based on raw politics. While the Bush Administration changed 64 percent of regulations under this process, the Obama Administration has changed 76 percent.”

Barack Obama, Ed Schultz Make GQ‘s ’LEAST Influential People Alive’ List

While magazines across the country offer readers their pick of the world’s “most influential people,” this year, GQ magazine is bringing you the “The 25 Least Influential People Alive” — and on the list are MSNBC host Ed Schultz, and, of all people, President Barack Obama. This is the same magazine that oddly, named Obama “Leader of the Year“ in 2009 and ”Man of the Year“ in 2008 while calling Sarah Palin ”dangerous“ and ”poisonous.”
But now, GQ has weighed the data and places Obama as the 25th least influential person in the world. Joining the president and Schultz are Daily Beast and Newsweek editor Tina Brown, along with Hosni Mubarak, Hank Williams Jr. and John Boehner, who came in at number 24.
While the issue has not yet been published, TVNewswer brought us a taste of what GQ had to say about Schultz:
…Then there pundits like Ed Schultz. Do you watch “The Ed Show” on MSNBC? Of course you don’t. No one does. The only reason people watch “The Ed Show” is they’re working out in a hotel gym and they can’t find a staff member to change the channel to ESPN.

Occupy Wall Street: The Implications on the Bill of Rights

For very good and valid reasons, Americans understand the extraordinary importance of the First Amendment to the U.S. Constitution, the right peacefully to assemble for redress of grievances. That, of course, is the rationale for the Occupy Wall Street (“OWS”) movement by which thousands of protestors are encamping in various public places around the country.
Our courts recognize few exceptions for the placing of limits on this exercise of free speech and in fact have themselves studied the issue in cases unrelated to OWS. Courts recently have been debating whether limits on speech enacted by legislative bodies are constitutional. As an example, a law prohibiting candidates for public office from lying about their opponents’ voting records during campaigns is drawing judicial scrutiny as an unconstitutional prohibition on protected free speech. This matter is a serious one and whether we agree or not with OWS protestors (or tea party assemblies) we need to treat the subject based on constitutional principles rather than our own political predilections. So why have the authorities suddenly stirred themselves to action to clean out OWS sites?
For one thing authorities have suddenly recognized some very important public principles:
First, public facilities are being taken over for the benefit of a few people as part of their attempt to advance solely their cause. Parkland in central cities is very scarce and has been misused by groups who pitch tents from end to end in these parks and prevent (and in some instances intimidate) ordinary citizens from using public land. Often these tent cities are abandoned during the day while the occupiers leave and go about their regular lives (going to work, going home, attending entertainment venues, etc.)
Recently, there has been a major spike in violence including shootings. In Oakland protestors succeeded in shutting down the ports, which are a major, job producer in that city. According to the San Francisco Chronicle “OWS protestors gathered up for their general assembly meeting and withdrew a resolution calling for future demonstrations to remain peaceful. A faction of the protest group has advocated violence as a ‘diversity in tactics’ approach to demonstrating.” Deaths have occurred in other cities as well, including Burlington, Vermont. Secondly, there is an important public health issue that has arisen. Protestors have been overwhelming the sanitary facilities at nearby businesses, cleaning and relieving themselves at bathrooms not built for such volume. Finally, city authorities who have appeared to be looking the other way see that they have to take action.
The Weekly Standard on November 5 noted, “[a real] occupation of Wall Street isn’t going to happen. Instead, it is something under which the left marches. For the left, all politics is about occupation. One country, one class or one group takes from another. Politics is seen as national warfare or class struggle, or one group grasping for advantages over some other.”
Moreover, Congressman Denny Rehberg summed it all up with an idea to respond to OWS with a call to liberate Wall Street.
We’re over-taxed in small business, over-regulated, and over-litigated, and you can pick and choose which ones you want to address, but the government should be trying to lessen the tax burden, lessen the regulatory burden, and get the litigation out of the way,” Rehberg said. More broadly, Liberate Main Street provides a rubric for a conservative agenda that contrasts with Occupy Wall Street. It would be an agenda that works to foster opportunity, not envy; that seeks change through democratic processes, not mob pressure; that encourages enterprise, not resentment; that enlarges the sphere of personal and civic freedom, not big government; that liberates Americans’ energies, rather than pandering to their weaknesses; that acts to fix Wall Street’s problems, not to demonize American business.
That violence has been on the agenda of elements within the OWS movement from the get-go is really no longer debatable. Ironically, the right peaceably to assemble is being compromised by those who want to turn thoughtful assembly into aimless mockery and occasional violence not just because of Wall Street, but also in support of every demand on every radical wish list from abolishment of all debt to the end of capitalism, corporations and government itself. Throw in a cheering section here and there for Chavez, Castro, and a sprinkling of crude anti-Semitism, and you have a movement that isn’t a movement at all, but rather a grand gripe conclave where those with real concerns and legitimate grievances are elbowed aside by those with agendas that serve no constructive purpose.
The time has come for law-abiding people of the left and the right to prevent peaceful assembly from being hijacked. Police, as happened in New York, cannot standby and look the other way. Finally, on November 15th, the Bloomberg administration stirred itself and closed Zuccotti Park (itself not a public park) because of the threat of violence and serious concern over public health.
We frequently write about American Exceptionalism by which we mean the unique opportunity our citizens have to legitimately pursue their dreams free from interference by government. This kind of opportunity cannot exist without the rule of law, which in the case of America is grounded in our Constitution, the centerpiece of which is the Bill of Rights. If we Americans want to maintain and protect our Bill of Rights (from which our right to peacefully assemble derives), all citizens must respect and vigorously support law enforcement that protects both the rights of the assembled as well as the rights of the communities in which these assemblages take place.

Obama admin attempting another Congressional end-around on ObamaCare defect

Under ObamaCare, the IRS becomes the arbiter of health-insurance acceptability. Now Barack Obama needs the IRS to rescue ObamaCare entirely, thanks to a massive legislative defect that the President has no hope of rectifying in the new Congress. Thanks to sloppy legislative work, the PPACA’s subsidies to taxpayers won’t apply in states that refuse to create exchanges — which means that the states have a clear mechanism to block ObamaCare’s implementation.
That is, unless the IRS just bypasses Congress and corrects the law:
The Patient Protection and Affordable Care Act offers “premium assistance”—tax credits and subsidies—to households purchasing coverage through new health-insurance exchanges. This assistance was designed to hide a portion of the law’s cost to individuals by reducing the premium hikes that individuals will face after ObamaCare goes into effect in 2014. (If consumers face the law’s full cost, support for repeal will grow.)
The law encourages states to create health-insurance exchanges, but it permits Washington to create them if states decline. So far, only 17 states have passed legislation to create an exchange.

It’s Wrong to Steal…Even When the Government Does It Using Asset Forfeiture

As a grumpy libertarian, I routinely get agitated about taxes, spending, and regulation. As far as I’m concerned, much of government is a racket that uses coercion to reward interest groups with unearned wealth.
But there are degrees of evil. So if you asked me to pick the most reprehensible thing that government does, “asset forfeiture” might be in second place (hurting poor people to benefit rich people is at the top of my list).
Asset forfeiture occurs when government seizes property that is associated with a crime. That sounds reasonable – and it is reasonable if someone is convicted of, say, bank robbery and the government confiscates the stolen cash and any loot purchased with that money.
But it is not reasonable (or moral, or just, or appropriate) when government seizes assets without a conviction. And it is downright disgusting when the government steals (and I use that word deliberately) the assets of innocent parties.
I’ve already written about this issue (including an example from my county) and highlighted how asset forfeiture gives government bureaucracies a perverse incentive to steal.
Now we have a story from the Wall Street Journal that confirms our worst fears.

Can the House “deem” a bill into law?

Republicans screeched when Louise Slaughter attempted to push a “deem and pass” strategy for ObamaCare a little over a year ago, arguing that the notion of deeming the bill as passed in the House without a direct floor vote was an affront to democracy and the Constitution. Democrats agreed — in 2003, when Republicans tried the same thing on a tax-credit measure. In the end, Democrats abandoned “deem and pass” as a strategy after less than a week and held a floor vote on ObamaCare instead, which passed.
Republicans swore to restore Constitutional processes if returned to the majority in the House. They’re not off to a great start. They have revived deem and pass, with a twist — instead of claiming that a bill has passed, the GOP voted that a House bill would be deemed as effective law if the Senate failed to act (via David Brauer):
The House narrowly passed legislation on Friday that calls for a House-passed FY 2011 spending bill to become law should the Senate fail to approve a spending bill by April 6. It would also prevent members of Congress from being paid during a government shutdown.

Appeals Court Fast-Tracks Obamacare Challenge

A federal appeals court has cleared the way for a legal challenge to Obamacare to be put on a fast-track through the appeals courts — on its way to the U.S. Supreme Court.This decision will expedite the legal process that is necessary for federal courts to rule on the legislation’s constitutionality.
Last Thursday, the U.S. Court of Appeals for the District of Columbia Circuit granted a motion by The American Center for Law and Justice (ACLJ) to fast-track an appeal of a decision by a federal district court in February that dismissed its lawsuit against Obamacare.

Obama Must Obey the Court on Obamacare

Judge Roger Vinson took the president to the woodshed last week for a lesson on which branch of government has the final word on the Constitution.
Twenty six states brought a lawsuit to a Florida district court challenging the constitutionality of the Obama healthcare reform law. On January 31, Vinson ruled the mandatory insurance provision unconstitutional and, going further, declared the entire law void. The White House brushed off Vinson’s ruling as “extreme” and an “outlier” and told the nation “implementation would proceed apace.”
Vinson clarified his ruling on March 3, warning the president’s lawyers that it was “not just a bit of friendly advice.” The administration suggests “that a single federal judge” cannot halt an entire regulatory scheme. Wrong, said Vinson. A court’s judgment is binding.

Washington Extra – Question of Constitution
Constitutional or unconstitutional? That is the question the U.S. Supreme Court eventually may get to decide on President Barack Obama’s landmark healthcare law.
(By one definition, constitution can also refer to one’s health — just throwing that in.)
A judge in Virginia declared unconstitutional a provision that requires individuals to buy health insurance or face a fine, backing arguments by the state that Congress exceeded its authority. 
The White House begged to differ.
“We disagree with the ruling,” White House spokesman Robert Gibbs said.
“We’re confident that it is constitutional,” he said.
If it does go to the highest court in the land, there are 4 liberals (Justices Stephen Breyer, Ruth Bader Ginsburg, Sonia Sotomayor and Elena Kagan), 4 conservatives (Chief Justice John Roberts and Justices Samuel Alito, Antonin Scalia and Clarence Thomas) and one moderate conservative (Justice Anthony Kennedy) who often controls the outcome.
My colleague Jim Vicini, who covers the Supreme Court, points out that the healthcare law issue which involves the power of Congress and interstate commerce may not fit strict conservative/liberal lines, so it would not be easy to predict the outcome if it comes to that.
